Public Offer Agreement No. 918-10/26-ЮГУ

The Federal State Budgetary Educational Institution of Higher Education "Yugra State University", represented by the Vice-Rector for Research and Legal Affairs Lapshin Valery Fedorovich, acting on the basis of Power of Attorney No. 142 dated 30.06.2025, hereinafter referred to as the "University", hereby invites any interested individual who has reached the age permitted in accordance with the legislation of the Russian Federation to accept this offer, hereinafter referred to as the "Author", to enter into an agreement for the publication of copyrighted materials in the scientific journal "Yugra State University Bulletin" (hereinafter referred to as the Agreement) on the terms and conditions specified below.

1. Terms and definitions

• Author - an individual (group of authors) whose creative work has resulted the Сopyrighted Material.
• Сopyrighted Material, Article, Materials, manuscript – original scientific, research, methodological material submitted by the Author for publication in the Journal (not previously published anywhere).
• Journal – scientific journal "Yugra State University Bulletin".
• Application (Questionnaire) – the Author’s request to publish an Article in the Journal.
• Publication – publication of the Article in the Journal.
• The Editorial Board of the Journal is the creative team that publishes the Journal.
• The Editor-in-Chief of the Journal is the official in charge of the editorial work of the Journal.
• Technical editing of the Article – checking the structure and format of the document, bringing it into compliance with the requirements of GOST (all-Union State Standard), VAK (State Commission for Academic Degrees and Titles).
• Service – processing and editing of manuscripts, placement (publication) of an Article in the Journal based on the Author’s Application.
• Website - a collection of pages on the Internet, united by a domain name: https://journals.eco-vector.com/byusu.

2. General provisions

2.1. This offer, in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation (hereinafter referred to as the "Civil Code of the Russian Federation"), is a public offer. This public offer (hereinafter referred to as the "Offer") shall enter into force upon posting on the Website and shall remain in effect until the University revokes the Offer.

2.2. The Agreement is concluded by accepting this offer, which contains all the essential terms of the Agreement, without its signature by the parties. This Agreement has legal force in accordance with paragraph 3 of Article 434 of the Civil Code of the Russian Federation and is equivalent to an agreement signed by the Parties.

2.3. Full and unconditional acceptance of this offer is described by the following:

2.3.1. posting of Copyrighted Materials by the Author on the Website through a personal account;

2.3.2. the Author submits on the Website through his/her personal account the completed Questionnaire (Annex No. 1), consent to the processing of personal data (Annex No. 2), consent to the distribution of personal data (Annex No. 3).

2.4. The University reserves the right to amend or revoke the terms of the Offer at any time at its sole discretion. If the University amends the terms of the Offer, the amendments will take effect upon posting the amended terms of the Offer online on the Website, unless a different period is specified by the University at the time of such posting. These amendments shall not apply to the mutual obligations of the University and persons who entered into the Agreement prior to posting the amended terms of the Offer online on the Website. The Author is solely responsible for monitoring the current content of the terms of this Offer.

2.5. By accepting the Offer, the Author guarantees that he/she has read, agree to, and fully and unconditionally accept all terms and conditions set forth in this Agreement. By accepting the Offer, the Author confirms that he/she has the legal right to enter into a contractual relationship with the University.

2.6. The Author accepts and gives his/her consent to the processing of cookie files on the Website in order to provide Website users (hereinafter referred to as Users) with personalized features of the Website, for personalized advertising displayed to Users, for statistical and research purposes, as well as for improving the Website. By performing the actions to accept this Offer, the Author confirms that he/she has reviewed the Privacy Policy of Eco-Vector LLC (Primary State Registration Number (OGRN) 1099847039907, Taxpayer Identification Number (INN)/Tax Registration Reason Code (KPP) 7806423692/784101001, location: Saint Petersburg, Aptekarsky Lane, Building 3, Litera A, Office 1N), posted on the Website, regarding cookie files, and expresses his/her consent to their use.

3. Subject of the agreement

3.1. Under this Agreement, the Author grants to the University, free of charge, for the duration of the copyright provided for by the legislation of the Russian Federation, the exclusive right in accordance with paragraph 2 of Article 1270 of the Civil Code of the Russian Federation and this Agreement to use the Сopyrighted Material (Article) created by the Author for publication in the scientific journal "Yugra State University Bulletin".

3.2. The rights to use the Copyrighted Material transferred under this Agreement include:

3.2.1. reproduction of the Article or its individual parts, as well as the Article metadata in Russian and English in any material form, including on paper and electronic media in the form of a separate work in journals and/or databases (local or on the Internet) of the University and/or other persons, at the discretion of the University;

3.2.2. distribution of the Article or its individual parts, as well as the Article metadata in Russian and English on any media included in the Journal and/or databases of the University or other persons, at the discretion of the University, or as an independent work throughout the world on an open access basis or by subscription without payment of remuneration to the Author;

3.2.3. making the Article or a separate part thereof, as well as the Article's metadata, available to the public in Russian and English in such a way that any person can access the Article from any place and at any time of their choice (including via the Internet);

3.2.4. granting permission to use the Article and its individual parts, as well as the Article's metadata in Russian and English, to third parties with notification of the Author by posting the relevant information on the Journal's website without paying remuneration to the Author;

3.2.5. processing, including translation of the Article (including into foreign languages), and the use of the processed (translated) Article in the above-mentioned ways;

3.3. Other rights not expressly transferred to the University under this Agreement, including patent rights to any processes, methods or techniques, etc., described by the Author in the Article, as well as trademark rights, are reserved by the Author.

3.4. The territory in which the use of rights to the Copyrighted Material is permitted is not limited.

3.5. If the Copyrighted Materials are provided by the Author in violation of the rules and requirements of this Agreement, the University has the right to refuse to post them.

4. Terms and conditions for the provision of services

4.1. The Author provides an Article that meet the requirements of the Offer and is formatted in accordance with the requirements posted on the Website.

4.2. The University provides the Service to the Author only if the following conditions are met simultaneously:

4.2.1. The Аuthor provided the questionnaire and the text of the Article by posting them on the Website through his personal account;

4.2.2. The Аuthor provided the Materials in accordance with the rules for submitting, reviewing and publishing manuscripts in the journal;

4.2.3. The Article contains all references to cited authors and/or publications required by current copyright legislation. The Author has obtained all necessary permissions for the results, facts and other borrowed materials used in the Article, the copyright holder of which is not the Author;

4.2.4. The author has accepted the Offer.

4.3. The rights to use the Copyrighted Materials are transferred by the Author to the University free of charge; the University does not pay remuneration to the Authors for publication of the Article in the Journal.

4.4. The Author retains copyright to the Article and grants the University the right of first publication of the Article.

4.5. If the Materials are provided by the Author in violation of the rules and requirements of this Offer, the University has the right to refuse their placement.

4.6. If the Article is not accepted for publication, the University will notify the Author, with the condition, that the Author provides a contact e-mail address or telephone number.

5. Rights and obligations of the parties

5.1 The Author guarantees that:

5.1.1. He/she is the actual copyright holder of the exclusive rights to the Article, granted to the University.

5.1.2. The copyrighted material provided under this Agreement does not violate the rights of third parties and contains all references to the cited authors and/or publications (materials) as provided for by the current copyright legislation;

5.1.3. The Author has obtained all necessary permissions for the results, facts and other borrowed materials presented in the Article, the copyright holder of which is not the Author;

5.1.4 The copyrighted material does not contain information that is not subject to publication in the open press, in accordance with the current legislative acts of the Russian Federation, and its publication and distribution will not lead to the disclosure of classified (confidential) information (including state secrets).

5.1.5. All co-authors have been informed of the terms of the Agreement and agree to enter into this Agreement.

5.2. The Author is obliged to:

5.2.1. Submit the Article in accordance with the rules for submission, review and publication of manuscripts in the Journal;

5.2.2. If there are other authors, inform them of the terms of this Agreement and obtain the consent of all authors to conclude this Agreement on the specified terms.

5.2.3. Make corrections/changes to the text of the Article as indicated by the reviewers and editors of the Journal and/or, if necessary, at the request of the University, to revise the Article.

5.3. The University is obliged to:

5.3.1 provide Services to the Author in the amount stipulated by this Agreement.

5.4. The University has the right to:

5.4.1.carry out technical and literary editing of the Article that does not change its fundamental provisions, without the consent of the Author;

5.4.2. review the Article and suggest that the Author make the necessary changes, until which the Article will not be published in the Journal;

5.4.3. establish the rules (conditions) for the acceptance and publication of the Journal's Materials. The Editorial Board of the Journal has the exclusive rights to select and/or reject Materials submitted to the Journal for publication. A printed article submitted by the Author to the Journal is non-returnable;

5.4.4. temporarily suspend the provision of Services to the Author under the Agreement due to technical, technological, or other reasons that impede the provision of Services, until such reasons are eliminated. The Editorial Board of the Journal will notify the Authors of this by email or phone number provided when submitting the Article;

5.4.5. post the abstract, keywords and full text of Articles published in the Journal on the Internet;

5.4.6. suspend the provision of Services under the Agreement unilaterally if the Article does not correspond to the subject matter of the Journal (or any part thereof), or the submitted Material is insufficient for independent publication, or the design of the Article does not meet the requirements, or in connection with the violation by the Author of other obligations assumed in accordance with the Offer, as well as for other reasons;

5.4.7. remove from the University Website Articles that violate the copyright of third parties;

5.4.8.  transfer the contact information of the Author of the Article to third parties whose copyright is violated by the Author's Article;

5.4.9. post preliminary information about the upcoming publication of the Article in information sources. 

6. Duration, changing and termination of the agreement

6.1. This Agreement shall be deemed concluded and shall enter into force from the moment of acceptance of the offer by the Author and shall remain in effect until the Parties have fully fulfilled their obligations under this Agreement or until its termination on the grounds provided for by this Agreement or the legislation of the Russian Federation.

6.2. Changes to the terms of this agreement and its early termination are permitted by agreement of the Parties.

6.3. At the initiative of one of the parties, the Agreement may be terminated on the grounds provided for in this Agreement and the current legislation of the Russian Federation.

6.4. Any amendments, changes and additions to the Agreement shall be valid only if they are made in written form and signed by the Parties.

6.5. Termination of the Agreement does not relieve the Parties from liability for violation of the terms of the Agreement that arose during its term.

7. Liability of the Parties

• • For failure to fulfill or improper fulfillment of their obligations under the Agreement, the Parties shall be liable in accordance with the current legislation of the Russian Federation.
  • The Author is responsible for the authenticity and completeness of the information provided to the University. If false information received from the Author is used, the University shall not be liable for any negative consequences resulting from their actions based on the false information provided.
  • The author bears full responsibility for:

7.3.1) compliance with the requirements of the legislation of the Russian Federation on advertising, on the protection of copyright and related rights, on the protection of trademarks and service marks, on the protection of consumer rights.

7.3.2) compliance with the publication ethics followed by the Editorial Board of the Journal.

7.3.3) the authenticity of the data presented in his Article;

7.3.4.) disclosure of commercial or state secrets, if such occurs in the Article;

7.3.5) the authenticity of personal data, as well as the personal data of co-authors;

• The University shall not be liable for the publication of Articles in the Journal that violate the copyrights of third parties. Responsibility for copyright infringement lies directly with the Author who submitted the Article to the Editors, in accordance with the current legislation of the Russian Federation. In the event of claims against the University related to the infringement of exclusive, copyright, or other intellectual property rights of third parties, the Author is obliged to:

7.4.1) immediately, upon receiving information about the violation of the rights of third parties, take measures to resolve disputes with third parties;

7.4.2) reimburse the University for legal costs and losses incurred as a result of the application of measures to secure the claim and enforce the court decision, as well as other losses incurred by the University in connection with the Author's failure to comply with the guarantees provided by him under this Agreement.

7.5. The University shall not be liable under the Agreement for:

7.5.1) any actions that are a direct or indirect result of the actions of the Author;

7.5.2) any losses of the Author, regardless of whether the University could have foreseen the possibility of such losses or not.

7.6 Without prejudice to the above, the University shall be released from liability for breach of the terms of the Agreement if such breach is caused by force majeure circumstances, including: actions of government authorities (including the adoption of legal acts), fire, flood, earthquake, other natural disasters, power outages and/or computer network failures, strikes, civil unrest, riots, any other circumstances, not limited to those listed, that may affect the University's performance of the Agreement.

8. Final provisions

• • All disputes and disagreements that may arise from this Agreement or in connection with it will be resolved by the Parties through negotiations, and in the event of failure to reach agreement, in accordance with the current legislation of the Russian Federation.
  • In the event of any unresolved disagreements between the Parties, disputes shall be resolved in court at the location of the University in accordance with the current legislation of the Russian Federation.
  • Any notifications, messages, requests, etc. (except for documents that must be sent as originals, in accordance with the legislation of the Russian Federation) are considered received by the Author if they were transmitted (sent) by the University through the Website, by e-mail specified in the Application (Questionnaire), and through other communication channels. The Parties acknowledge the legal force of notifications, messages, requests, etc., transferred (sent) by the specified methods.
  • In all other respects not provided for in this agreement, the Parties shall be guided by the current legislation of the Russian Federation.

1. I give consent for the purpose of granting the University the right to use the Copyrighted Materials (Articles) of which I am the author (co-author) in the scientific journal “Yugra State University Bulletin”.

2.1) Personal data means the following information:

Last name, first name,; ORCID iD; SPIN code; Scopus Author ID; ResearcherId; details of education; academic degree, academic title; details of work experience (place of work, department, position, work phone number); personal phone number, email (or other means of communication); other personal data contained in other documents provided by me and necessary to achieve the purposes of their processing.

2.2) The processing of personal data means actions (operations) with personal data within the framework of the implementation of the Federal Law of 27.07.2006 No. 152-FZ "On Personal Data", namely: collection, recording, systematization, storage, accumulation, clarification (updating, modification), extraction, use, transfer (provision, access), depersonalization, blocking, deletion, destruction of personal data.

I give my consent to the processing of personal data both with and without the use of automation tools..

I agree that my personal data specified in paragraph 2.1 of this consent may be transferred in documentary and electronic form to various government authorities, third parties, if required by the legislation of the Russian Federation, other regulatory legal acts of the Russian Federation, the Khanty-Mansiysk Autonomous Okrug - Yugra, local governments or in the event of the University's fulfillment of obligations under agreements.

3. The subject has the right to receive information regarding the processing of personal data upon written request.
4. Upon receipt by the University of a written application from the Subject to terminate this consent, personal data shall be subject to destruction within 10 days (except for information the storage of which is required by the legislation of the Russian Federation).
5. I have read the Regulation on the protection of personal data at the Federal State Budgetary Educational Institution of Higher Education "Yugra State University".
6. I am informed that the confidentiality of personal data is maintained within the framework of the University's compliance with the legislation of the Russian Federation.
7. This consent is given for the period until the expiration of the storage periods for the relevant information or documents containing said information, as determined in accordance with Russian Federation law. I am informed that I have the right to revoke my consent to the processing of personal data by written request.
